Terms of Service for Beny

Please read these Terms of Service ("Terms") carefully before using the Beny App.

By downloading, accessing, or using the Beny application and related services (the "Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. Eligibility

• You must be at least 18 years old to use Beny.
• If you are between the ages of 18, you represent that you have your parent's or guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf.
• You are responsible for ensuring your use of the Service is compliant with all local laws.

2. User Accounts

• Account Creation: You must provide accurate and complete information when creating your account and are responsible for keeping your login credentials secure.
• Account Responsibility: You are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
• Username: We reserve the right to refuse, change, or remove usernames that are offensive, impersonate another person, or violate intellectual property rights.

3. User Conduct and Content Guidelines

You retain all ownership rights to the content you create and share on Beny ("User Content"). However, you agree to abide by the following rules:

A. You agree NOT to:

• Post content that is illegal, pornographic, sexually explicit, violent, or promotes self-harm.
• Post content that infringes on any third party's copyright, trademark, or other intellectual property rights.
• Post content that is defamatory, fraudulent, deceptive, threatening, harassing, bullying, or hate speech.
• Post spam, engage in excessive self-promotion, or post commercial content not authorized by Beny.
• Impersonate any person or entity or misrepresent your affiliation with anyone.
• Use the Service for any illegal or unauthorized purpose.
• Interfere with or disrupt the Service or servers connected to the Service.
• Use any automated system (e.g., "bots," "spiders") to access the Service or extract data.

B. License You Grant to Us:
By posting User Content on Beny, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, create derivative works, communicate, publish, and display your User Content for the purpose of operating, developing, providing, promoting, and improving the Service.

4. Our Intellectual Property

The Beny Service, including its design, text, graphics, images, logos, software, and all other content therein (excluding your User Content), is the property of Beny or our licensors and is protected by copyright, trademark, and other laws. You may not use our name, logos, or trademarks without our prior written consent.

5. In-App Purchases & Virtual Currency

• Beny may offer virtual currency ("Beny Credits" or "Balance") and digital goods for purchase.
• Virtual Nature: All virtual currency and digital goods are licensed, not sold, to you. They have no monetary value and are non-transferable, non-exchangeable, and non-refundable except as required by law or at the discretion of the app store.
• Payment Processing: All purchases are handled by third-party platforms (Apple App Store, Google Play Store). You agree to their terms and conditions. We are not responsible for any issues related to payment processing.
• No Refunds: All purchases are final. We do not provide refunds for any unused virtual currency or digital goods, except as required by applicable law. Billing issues must be resolved with the app store provider.

6. Termination

• By You: You may stop using the Service and delete your account at any time through the app settings.
• By Us: We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if we believe you have violated these Terms, the law, or engaged in conduct that is harmful to other users or Beny.

7. Disclaimers

The service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the fullest extent permitted by law, Beny and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the service.

9. Indemnification

You agree to indemnify and hold harmless Beny and its affiliates from any claim, demand, loss, or damage (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

10. Governing Law and Dispute Resolution
